A former Kutztown University student was held for court Wednesday on homicide charges in the fatal shooting of an 18-year-old Reading man in a Maxatawny Township housing complex near the campus, state police said.
Xzavier Wayman, 22, of Philadelphia was returned to Berks County Prison without bail to await further court action following his preliminary hearing before District Judge Gail M. Greth in Fleetwood.
Wayman faces charges of first- and third-degree murder and related counts in the killing of Diego Velazquez on Nov. 12 at Advantage Point Student Apartments, 435 Baldy Road. KU officials said Wayman was last enrolled during the fall 2021 semester.
He was arrested Dec. 5 when he arrived at the Berks County Courthouse for an unrelated proceeding following the investigation by state police in Reading that leaned heavily on security camera footage.
According to prosecutors:
A Kutztown borough police officer arrived first on the scene in response to a 911 call for a shooting. He was escorted by student residents to the fourth-floor stairwell where he found a male later identified as Velazquez unconscious with a single bullet wound to the left side of his abdomen.
The officer attempted lifesaving measures before being relieved by emergency medical personnel.
Velazquez was taken to Lehigh Valley Hospital, near Allentown, where he was later pronounced dead.
A security officer called 911 to ask for help to disperse a large crowd that had formed on the fifth floor, where there was evidence of a party. Two troopers arrived moments later. Taking the elevator to the fifth floor, they saw bullet holes on a hallway wall and found the victim being treated by first responders in the fourth-floor landing area.
Security footage of the fifth-floor hallway shows a male wearing dark sunglasses and a black hooded top, later identified as Wayman, talking with another male, who is identified only as wearing a black top with a New Balance logo on the back. That male argued with Velazquez, who appeared to have a firearm in his waistband, and associates of Velazquez’s.
Shortly after the confrontation, Wayman pulled out a firearm and fired down the hallway toward Velazquez and at least four bystanders. Wayman fired three rounds. Two bullets struck the wall on the north side of the hallway, and the other struck Velazquez, who fired one shot before fleeing toward the stairway.
Wayman took the elevator to the lobby and left through the main entrance.
He returned to the building and was seen walking to the west stairway, which was where Velazquez was found. He ran into and out of the stairway entrance repeatedly and was later seen running back and forth in the parking lot with what appeared to be the associates.
They were seen walking toward the Golden Bear Village student housing complex, and Wayman went into an apartment. He was seen entering and leaving the apartment during the remainder of the weekend.
On Nov. 14, two days after the shooting, troopers obtained a warrant to search the apartment and found a backpack, a wallet containing Wayman’s student ID card from 2021 and other forms of identification.
