The prosecutor added Kyle Stone The jury indicted Beau Schneige, 24, and Camden Burch, 24, of managing Canton PoliceFriday, was charged with manslaughter in the death Frank Tyson (53 years old), who was handcuffed after being suspected of leaving the scene of a car accident on April 18.
“No one is above the law,” Stone said at a press conference. “No one is in such a weak position that they do not deserve to be protected.”
Body camera footage released by Canton police earlier this year showed officers arresting Tyson at a nearby bar on suspicion of fleeing the scene of his car crashing into a power pole.
After the police officers were able to throw him to the ground and handcuff him, a policeman appeared in the footage placing his knee on Tyson’s back near his neck for about 30 seconds.
Tyson could be heard saying: “I can’t breathe. I can’t… get off my neck,” while a police officer shouted, “Calm down” and “You’re okay.”
Tyson appeared in the clip lying motionless with his face on the ground for about 8 minutes before the police checked his pulse, removed the handcuffs, and began performing cardiopulmonary resuscitation. Tyson was later declared dead at a local hospital.
During a press conference held on Saturday, the Tyson family’s lawyer described the charges as a step towards achieving justice.
“We realize this is just one step toward getting justice for Frank and his family on what has been a long and very difficult journey. It is extremely rare to achieve an outcome like this,” attorney Bobby DiCillo said.
This charge carries a penalty of up to 36 months in prison and a fine of $10,000.
