NORRISTOWN — A Springfield Township man admitted to creating and possessing child pornography, including taking photos of a 13-year-old girl in various stages of nudity, and awaits his fate from a judge.
Daniel C. McIntyre, 40, of the 100 block of Erdenheim Road, pleaded guilty in Montgomery County Court to multiple felony charges of creating and possessing child pornography and corruption of a minor in connection with incidents that occurred between 2022 and 2023.
Judge Thomas P. Rogers deferred sentencing so that court officials could complete background investigation and risk assessment reports about McIntyre, who will also undergo a psychosexual evaluation.
The open guilty plea means McIntyre has no deals with prosecutors regarding his potential sentence. McIntyre faces a possible maximum sentence of 13½ to 27 years in prison on the charges. However, state sentencing guidelines could allow for a lesser sentence.
McIntyre, who was remanded to the county jail without bail to await his sentencing hearing, also faces an evaluation by the Pennsylvania Sexual Offenders Assessment Board which will determine if he meets the criteria to be classified as a sexually violent predator. Those classified as predators face more stringent restrictions while on parole or probation, including mandatory counseling.
An investigation of McIntyre began in October 2022 when the mother of a 13-year-old girl reported to Springfield Township police that she was concerned about the relationship between McIntyre, who was 38, and her daughter after she discovered that McIntyre had provided the girl with a cellphone, according to court documents.
When detectives viewed the contents of the cellphone, they found dozens of photos of the girl in various stages of nudity that were clearly taken by another person. The photos were taken in the bedroom of McIntyre’s Erdenheim Road residence, according to the criminal complaint filed by Springfield Township Detective Stephen P. Craig.
Detectives subsequently went to McIntyre’s residence with a search warrant and seized his cellphone, a laptop computer and two computer hard drives, according to the arrest affidavit.
A search of McIntyre’s cellphone uncovered accounts which were used to message the 13-year-old girl and they also discovered several child sexual abuse images of females between the ages of 3 and 13, court papers indicate.
A search of McIntyre’s laptop computer and the computer hard drives uncovered hundreds of images and videos of child sexual abuse material including some of which depicted toddlers and infants, according to the criminal complaint.
“In addition, McIntyre used a device he provided to a 13-year-old female to take exploitative photos of her while in various stages of nudity and consciousness. Those photos were transmitted from the device to a cloud storage account. The email address assigned to that device was also accessed by Daniel McIntyre’s cellphone multiple times after the photos were taken,” Craig alleged in the arrest affidavit.
Taking the photos and then transmitting them to a Google Photos account in the cloud is indicative of the production and transmission of child sexual abuse material, detectives alleged.
A charge of criminal use of a communication facility is slated to be dismissed against McIntyre at the time of sentencing.
