The Abu Dhabi Family, Civil and Administrative Claims Court has ordered a workshop and one of its employees to pay AED 20,000 in compensation for using a customer’s car and committing a traffic violation.
The details of the case go back to the complainant handing over his car to the workshop (the defendant) for repair, but he was surprised when one of the workers in the workshop (the second defendant) drove his car without his permission and committed a serious violation, including driving the car while intoxicated, as a result of which the car was impounded.
The complainant was harmed by the actions of the defendants and incurred expenses, fees, renting a car, transporting it, and releasing it due to the defendants’ mistake, which prompted him to file the present lawsuit, demanding that the court oblige the defendant to pay him 31,623 dirhams, in addition to 30,000 dirhams as moral compensation, and obligating them to pay the fees and expenses.
The court stated in its ruling that the second defendant, who works for the workshop, drove the complainant’s vehicle without his permission, which resulted in material damages to the complainant, in the form of a traffic fine of AED 195. Driving the vehicle while intoxicated also resulted in the complainant’s vehicle being impounded, so the latter removed it from the impoundment caused by the second defendant and paid AED 2,700 for the impoundment. He also paid a total of AED 1,100 to transport the vehicle to and from the impound lot and the garage. He also rented a car for the entire impoundment period for AED 5,100.
Accordingly, the court ruled that the two defendants must jointly and severally pay the complainant 20 thousand dirhams.
